November 2026 Visa Bulletin: Who Can File an I-485 Now, and 3 Filing Traps to Avoid

USCIS says employment-based filers use the Dates for Filing chart in November 2026, which lets Rest of World EB-2 NIW applicants with priority dates before March 15, 2026 file. Here is who qualifies, and the new form, address, and public charge rules to get right.

Every month, a lot of EB-2 NIW applicants open the Visa Bulletin hoping to see one thing: that it's finally their turn to file for a green card. The November 2026 Visa Bulletin is good news for many of them. But this month there is also a catch. Three recent rule changes can get a perfectly eligible application sent straight back.

Here is who can file now, and how to avoid those three traps.

The two charts, in plain English

The Visa Bulletin has two tables, and they answer two different questions.

The Final Action Dates chart tells you when a green card can actually be approved. The Dates for Filing chart tells you when you are allowed to send in your I-485, the green card application, a bit earlier, so it can be waiting in line.

Each month USCIS decides which chart applicants must use. For November 2026, it chose the friendlier one: all employment-based applicants use the Dates for Filing chart.

Can you file this month?

Your priority date is the day USCIS received your I-140 petition. It's on your receipt notice. Find the row for your category and the column for your country of birth. If your priority date is earlier than the date shown, you can file.

Here are the November 2026 Dates for Filing for employment-based categories, from USCIS:

Category Rest of World China India
EB-1 Current July 1, 2024 July 1, 2024
EB-2 (including NIW) March 15, 2026 January 1, 2023 January 15, 2015

Mexico and the Philippines follow the Rest of World EB-2 date. None of the EB-2 filing dates changed from October.

So if you were born outside India and China and your I-140 reached USCIS before March 15, 2026, you can file your I-485 in November.

What moved, and what didn't

According to immigration firms that reported on the bulletin released October 22, the EB-2 Rest of World Final Action Date moved forward three months, from January 1, 2025 to April 1, 2025. China and India did not move. Please double-check these dates on the official bulletin at travel.state.gov before you rely on them.

In practice, Rest of World applicants can file now but will still wait for approval until the Final Action Date reaches them. For India and China, the line is still long.

Trap 1: using the old I-485 form

On September 18, 2026, USCIS released a new version of Form I-485, dated 09/18/26, to match a new public charge rule. USCIS has said there is no grace period, so older versions are rejected.

If you downloaded the form or used a template before mid-September, download it again from uscis.gov. The edition date is printed at the bottom of every page, so check each one.

Trap 2: mailing it to the old address

USCIS recently changed where some I-485 packets should be mailed. The right address depends on your situation, for example whether you are filing together with your I-140 or after it was already filed.

USCIS will still accept packets sent to an old address only if they are postmarked on or before November 9, 2026. After that, use the address on USCIS's I-485 filing addresses page, and check it on the day you mail, not the week before.

Trap 3: missing the public charge changes

That new form exists because a new public charge rule took effect on September 18, 2026. Answer every public charge question carefully, and make sure your answers match your documents. If you or your family have received any public benefits, talk to an immigration attorney before you file.

A short November checklist

  1. Check your priority date against the Dates for Filing chart for your country of birth.
  2. Download a fresh 09/18/26 Form I-485 and check the date on every page.
  3. Look up the current mailing address for your filing type on the day you send it.
  4. Include your I-140 receipt or approval notice and your civil documents, such as your birth certificate.
  5. If you want permission to work and travel while you wait, include those applications too, and plan renewals early, because work permits no longer extend automatically.

The bottom line

November is a good month for Rest of World EB-2 NIW applicants. If your priority date is before March 15, 2026, you can file now. The real risk this month isn't eligibility, it's paperwork. An old form or an old address can cost you weeks.
