1. What this kit covers

This guide covers an employment-based second-preference petition in which the person:

1. qualifies for the underlying EB-2 classification as either an advanced degree professional or a person of exceptional ability; and
2. asks USCIS to waive the usual job-offer and permanent labor-certification requirements because doing so is in the national interest.

An NIW may be self-petitioned. Approval of Form I-140 does not itself grant lawful permanent residence, employment authorization, permission to remain in the United States, or permission to travel. The green-card stage is separate: eligible people in the United States may seek adjustment of status, while others generally use immigrant-visa consular processing.

How the documents work together

The primary drafting document is the EB-2 NIW Petition Letter Template. It produces one continuous petition brief containing the introduction, underlying EB-2 eligibility, proposed endeavor, all three Dhanasar prongs, conclusion, and exhibit index.

The six companion documents are:

• the petition cover helps format the opening and filing identification;
• the proposed-endeavor statement develops the detailed factual plan;
• the recommendation pack supports third-party letters;
• the exhibit index controls evidence;
• the filing checklist reduces intake errors; and
• the RFE framework is used only if USCIS issues a notice.

They are not six separate alternatives to the full petition.

2. The decision tree

Gate A - underlying EB-2 eligibility

Choose and document at least one route.

Advanced-degree professional

• A U.S. advanced degree, or foreign equivalent, related to the occupation; or
• a U.S. bachelor's degree, or foreign equivalent, followed by at least five years of progressive post-baccalaureate experience in the specialty.

The proposed endeavor and intended work should be in the profession for which the person is qualified. Obtain a reliable credential evaluation when foreign education is not self-explanatory. Experience letters should describe dates, role, duties, and progression rather than merely confirm employment.
