EAD Automatic Extension Is Gone: What It Means If Your I-485 Is Pending

A DHS final rule published October 14, 2026 makes the end of automatic EAD extensions permanent. If you filed an I-485 after your EB-2 NIW and work on a C09 card, here is what changes and how to avoid a gap.

If you are waiting on a green card, your work permit used to have a quiet safety net. As long as you filed your renewal on time, your old card kept working while USCIS caught up, sometimes for well over a year. That safety net is now gone for good.

On October 14, 2026, DHS made the end of the EAD automatic extension permanent. Here is what that means if your I-485 is pending, and what you can do so you are never caught without the right to work.

First, a quick translation

A few terms come up a lot, so let's get them out of the way.

Your EAD (Employment Authorization Document) is the work permit card USCIS mails you. When you file an I-485, the green card application, you can also ask for an EAD so you can work while you wait. That card is in category C09. Many people get a combo card, which works as both a work permit and a travel document called advance parole.

What actually changed

Until late 2025, if you filed to renew your EAD before it expired, the old card was treated as valid for up to 540 extra days while USCIS worked on the renewal. You could keep working even if the new card was late.

In October 2025, DHS ended that with a temporary rule. On October 14, 2026, it made that rule final, with no changes. For any renewal filed on or after October 30, 2025, there is no automatic extension anymore. When the date on your card passes, your permission to work under that card ends, even if your renewal is still sitting in a queue.

There are narrow exceptions, such as extensions written into law and some Temporary Protected Status cases. For most EB-2 NIW families, they do not apply.

DHS itself expects this to cause gaps. Its own estimate is that roughly 20,000 to 33,000 work permits will lapse during an 18-month stretch starting in May 2027.

Why this hits EB-2 NIW families

An approved EB-2 NIW petition does not let you work on its own. Once your priority date allows it, you file your I-485 and often an EAD application with it. From then on, the C09 card may be the thing standing between you and a paycheck.

You are most at risk if:

  • you left H-1B, F-1, or another status and now work only on your C09 card,
  • your spouse works on their own C09 card as part of your case, or
  • you rely on a combo card to travel. The travel part of that card was never covered by the old extension, so once the card expires you cannot use it to come back into the US.

If you are on H-1B and still working on that status, this rule does not take your H-1B away. In fact, it is the best argument for keeping your H-1B alive while your green card is pending. It is your backup if the EAD runs out.

How to protect yourself

You cannot make USCIS faster, but you can plan around it.

Know your dates. Write down the expiry date of every card in your household, then set reminders at six months, four months, and three months out.

Renew as early as you are allowed. USCIS generally accepts EAD renewals up to 180 days before the current card expires. Check the latest Form I-765 instructions for your category before you send anything.

Keep your other status if you have one. If you are on H-1B, don't let it lapse just because the I-485 is filed.

Give your employer a heads-up. When your EAD expires, your employer has to check your work authorization again on Form I-9. Telling HR months ahead is far better than a surprise on the last day.

Don't travel on an expired combo card. If you need to travel while a renewal is pending, talk to an immigration attorney first.

The bigger picture

This rule is part of a pattern this year: fewer safety nets and less room for delay. USCIS can now deny a petition that is missing required documents without asking for them first (more in why your EB-2 NIW petition must be complete on day one). The common thread is that planning ahead now matters more than ever.

The bottom line

If your I-485 is pending and you work on a C09 card, treat the date on that card as a real deadline. Renew early, hold on to any other status you have, and keep your employer in the loop.
